What is Mediation?
It is an informal process in which a mediator, trained in negotiation techniques, assists both parties to reach a mutually acceptable settlement
agreement and parenting plan/child support, if children are involved. What distinguishes mediation from other forms of disputes
resolution, principally litigation, is that the mediator does not impose a solution but rather assists the parties to create their
own agreement which is unique to their situation.
Once you have decided that both parties would like to participate in a mediation
prior to filing for a divorce, you would contact the office and set up the initial three (3) hour appointment.
My office
will send both parties an information packet to complete prior to the appointment. At the appointment, Diane Dramko will meet with
both parties, review the prepared information packet and begin discussing the pending issues.
If the parties come to an agreement,
Diane Dramko will prepare the agreement for the parties signature. If either party wishes to discuss the agreement with an attorney,
another session is set up for the parties to return to sign the agreement or discuss the matter further. If neither wishes to
have an attorney review the documents, the agreement is signed by both the parties.
If an agreement is not reached at the first
sessions, another session will be set up.
The parties would then take the agreement along with the other required documents for
the divorce and file it with the clerk's office with the appropriate filing fee.
